Role Title: Director – Employment Law

Location: Whippany, NJ

What will you be doing:

The Employment Law Director will be part of the Employment, Incentives & Pensions team in the Americas region (Canada, U.S., Mexico, Brazil), which provides legal support for Barclays’ regional businesses (primarily investment banking, corporate banking and the credit card businesses) as well as support for Barclays Execution (“BX”).This role will work and coordinate with the global EIP team to seek to ensure that employment policies, training and practices are in compliance with regional law, mitigate risk, as well as oversee employment litigation.

Key Accountabilities

·Provide employment legal advice and counsel in connection with matters presenting material employment legal risk including through support of organizational change and support of investigation matters (including those performed by HR/Employee Relations specialist team)

·Managing all forms of employee disputes and litigation matters, including agency charges, arbitration proceedings, and court litigation

·Advising on restrictive covenant issues;

·Drafting and negotiating employment agreements; developing templates and forms;

·Serving as partner to Compliance to satisfy regulatory reporting obligations associated with employment issues (e.g., separation / U5 reporting)

·Advising on the employment law issues relating to sales, spin-offs, and acquisitions and similar transactions

·Advising on wage-and-hour practices, including overtime issues, and on the administration of compensation programs, such as equity-based programs and deferred compensation arrangements; advising on 409A and other related issues

·Working with HR on the development and drafting of employment policies and their application under various state and federal laws

·Develop and deliver employment law training for HR and others to proactively address issues and/or changes or developments in law

·Working with human resources at Barclays and outside counsel on the development and administration of diversity-related initiatives; supporting compliance reviews/audits

What we’re looking for:

oJ.D. with admission to NY State Bar

o12+ years of experience as an employment lawyer

Skills that will help you in your role:

oExtensive financial services experience

oStrong analytical skills; ability to efficiently analyze employment-related issues and effectively identify options with recommended solutions

oHighly flexible and adaptable personality with exceptional communication skills and ability to navigate governance structures in highly matrixed organization

oExperience leading people

oExperience developing and managing processes

oBreadth of legal experience that reflects ability to learn quickly on the job

oGood judgment; ability to consider different courses of action in broader context of organizational culture and develop proper recommendations to solve problems and manage employment law risk

oStrong organizational skills; ability to manage multiple projects simultaneously without compromising quality of service
