Role Title:  EU Director, Financial Crime Legal

Location:   Frankfurt, Germany

What will you be doing:

      • The role will sit in Frankfurt, Germany reporting to a Director in BI Legal in Frankfurt with a “dotted line” to the EME Head, Financial Crime Legal in London.
      • To provide strategic leadership on legal issues relating to financial crime, working with other functions to improve the efficiency and effectiveness of financial crime risk management within the EU region and across the Bank, providing an effective oversight of and credible challenge on financial crime issues.
      • To deliver functionally excellent legal advice in relation to financial crime matters, with subject matter expertise in ABC, AML and CTF and financial sanctions.
      • To collaborate with Financial Crime Compliance (Sanctions, ABC, AML, FIU and the MLROs), Compliance (including Regulatory Compliance), Legal (particularly Product Legal and Litigation, Investigations & Enforcement), Audit, regional management and the businesses to ensure the delivery of an improved risk management strategy and culture within the EU region, including supporting financial crime projects, policy revisions and implementation. 
      • To proactively seek to identify unmanaged risk and emerging trends within the EU region and help deliver legal advice on procedures and controls of to anticipate those trends and deliver sustainable value within the region and to the Bank globally.
      • To provide legal support to the Regional MLRO, Business MLROs and financial crime compliance teams within the EU region.
      • To collaborate with Litigation, Investigations & Enforcement and Financial Crime Compliance in the execution and management of investigations and enforcement actions relating to financial crime issues.
      • Where necessary, provide additional support on matters handled by the Financial Crime Legal team, globally.  
    • Instruct and manage external counsel as required.

Key Accountabilities

      • Provide timely, expert, pro-active legal advice on AML, CTF, ABC and financial sanctions to stakeholders, particularly in the EU region.
      • Support and advise regional management team and senior management in relation to financial crime issues. 
      • Support the provision of strategic oversight of financial crime issues in the EU, including advice in relation to thematic reviews, forthcoming industry issues, best practice sharing and standardised Barclays procedures.
      • Support the provision of strategic oversight and direction in support of Financial Crime Compliance projects, policy preparation and implementation.
      • Engage and support engagement with key regulators in the EU on ongoing and emerging financial crime legal developments including but not limited to AML reform projects. 
      • Partner with the Litigation, Investigations & Enforcement, Intelligence Development and Investigations in the execution and management of investigations and enforcement actions relating to financial crime issues.
      • Assist with the development and implementation of governance and reporting across the Financial Crime Legal team, including the provision of periodic Management Information.
      • Help prepare and participate in the delivery of key briefings and training programmes to senior management, key business stakeholders, and wider legal and compliance teams, especially on emerging financial crime legal developments.   
      • Actively participate in Financial Crime Legal team activities and development opportunities.
      • Where providing legal services:
    • maintain an appropriate balance of business knowledge and other legal expertise;
    • manage the balance of providing in-house legal advice or outsourcing to an external law firm;
    • manage the provision of external support;
    • maintain control, quality and consistency of external advice sought across the Bank;
    • strictly maintain cost and budgeting discipline in external service purchasing;
    • drive high quality, cost effective and speedy sustainable resolution of legal issues; and
    • co-ordinate the development of processes, policies, and procedures designed to reduce legal risk throughout the financial crime practice group.

What we’re looking for:

  • Qualified lawyer (Solicitor, Barrister, Attorney or equivalent). 
  • Post Qualification Experience in two or  more of the following areas:  Bribery & Corruption laws including either the UK Bribery Act or the US Foreign Corrupt Practices Act; Legal and regulatory requirements in relation to anti-money laundering/terrorist financing and the proceeds of crime; Legal and regulatory requirements in relation to international and local economic sanctions and export controls generally; Fraud and other financial crime; Court orders; Internal financial crime investigations; Regulated financial institutions. Experience of any of these areas within the EU region would be preferrable.

Skills that will help you in your role:

  • Understanding of the requirements of legal risk management in a financial institution.
  • Previous experience working in-house within the financial services industry, or experience representing the financial services industry in other contexts, e.g., law firm.
  • Experience of operating within the EU region.
