Risk and Control Objective

Take ownership for managing risk and strengthening controls in relation to the work you do

Working Flexibly

Structured hybrid role:
At Barclays, we offer a hybrid working experience that blends the positives of working alongside colleagues at our onsite locations, together with working from home.  We have a structured approach where colleagues work at an onsite location on fixed, ‘anchor’, days of the week, for a minimum of two days a week or more, as set by the business area (or nearest equivalent if working part-time hours). Please discuss the working pattern requirements for the role you are applying for with the hiring manager. Please note that as we continue to embed our hybrid working environment, we remain in a test and learn phase, which means that working arrangements may be subject to change on reasonable notice to ensure we meet the needs of our business.

Introduction:
The role holder will sit within the CIT Legal team and will be responsible for providing legal advice on a range of commercial, innovation and technology contract work-types (English law governed), facing off to a variety of stakeholders including Barclays’ Procurement function and front-line business teams.

What will you be doing?
The role will include the following main duties and responsibilities:
•    Drafting, reviewing and negotiating contracts in order to effectively manage and mitigate legal and regulatory risk.
•    Proactively identifying, escalating and addressing legal risk issues arising from:
•    contracts (or non-contractual projects with a technology/commercial legal focus) to be entered into by members of the Barclays Group (both within the UK and globally); and
•    the operations and technology functions’ work generally as well as support of Barclays’ service company, by providing prompt, commercial and pragmatic advice.
•    Ensuring that contracts and other documents (including relevant Policies, process documents, etc) comply with the applicable regulatory framework, including regulations on outsourcing, operational continuity, ring-fencing and the appointed representative regime.
•    Proactively liaising with and involving other members of the legal and compliance functions and other stakeholders throughout the Barclays Group on legal risk matters.
•    Effectively and proactively participating in, influencing and driving the development of processes, policies and procedures designed to manage, mitigate and reduce legal risk and/or increase the efficiency of the team, including development and maintenance of relevant precedents and other know-how items.
•    Maintaining effective file management practices including use of the team’s electronic filing platform and record management requirements.
•    Sharing know-how and experience with other legal advisers within the team and elsewhere within the Legal Function.
•    Proactively forging relationships with a broad range of legal and business areas and third parties in order to encourage the best quality output and service from the team.

What we’re looking for:
•    Qualified lawyer (Solicitor, Barrister or equivalent in the role holder’s relevant location), with relevant post-qualification experience (in-house and/or private practice) ideally with one or more of the following areas: software/fintech, commercial contracts, payments, financial services, e-commerce.
•    Legal graduate.
•    Strong technical knowledge of commercial agreements and experience in negotiating and advising on general commercial/technology contracts, preferably including a range of agreements from the following examples (this is an illustrative list):
•    software, data and index licences;
•    proof of concept agreements;
•    non-disclosure/confidentiality agreements;
•    service agreements;
•    hardware and software maintenance agreements;
•    software development agreements;
•    software-as-a-service agreements;
•    donation agreements;
•    intellectual property licence agreements;
•    sponsorship agreements;
•    termination agreements; and
•    outsourcing services agreements.
•    Technical knowledge and experience above to be based on English law contracts or equivalent (e.g. experience of the laws, and ideally contract principles, in a comparable legal system (including Common Law jurisdictions) with a similar legal framework to those found in contracts governed by English law, on the basis that most of the contracts within the scope of this role will be English law contracts).
•    Strong stakeholder management skills, ability to work cross-functionally in a collegiate and professional manner, and willingness to support projects led by other teams and functions.
•    Strong communication skills (including speaking, reading, writing and listening) in English language.  Knowledge of a foreign language and other local language will be an added advantage.
•    Excellent attention to detail, organisational and time management skills – with the ability to manage a range of tasks and responsibilities to a high quality, to deliver tasks and manage processes in a consistently accurate and efficient manner, to plan and deliver tasks to deadlines (and, where applicable, in line with team SLAs), to prioritise work effectively and to work flexibly to meet team and stakeholder needs.
•    Ability to demonstrate Barclays’ Values and Mindset, and to support colleagues (including their wellbeing, and contributing positively and proactively to a supportive and inclusive team culture).
•    High motivation, initiative and professionalism.

Skills that will help you in the role:
•    Experience with innovation, FinTech/payments businesses and regulatory environments.
•    Experience of the financial services industry, either in house with a financial services organisation or with a significant law firm.
•    Understanding, knowledge and experience of Barclays and its operational and strategic objectives.
•    Demonstrable experience of identifying improvements in processes and ways of working and supporting the implementation of the same.
